The digital notice, California Workplace – Know Your Rights contains information about several topics including workers’ compensation, immigration protections, the right to engage in concerted activity, and constitutional rights when interacting with law enforcement.

You may provide the notice to your employees by personal service or digitally (email or text message) if it can reasonably be anticipated that the employee will receive it within one business day of sending.

You must keep records of notice delivery for three years, including the date each written notice was sent.

California law requires you to provide the notice in the language you normally use to communicate employment-related information to your employees if the Labor Commissioner has published a template in that language. If the template is not available in that language, the notice may be provided in English.

Even if you employ only one person in California, you are required to post current employment notices and distribute certain pamphlets. Be sure to display a poster in each business location where employees can easily see and read it.

You’ll need both the English and Spanish kit versions if you also have Spanish-speaking employees.

When distributing these pamphlets, you’ll want to make sure you have the most current versions.

Remember, not informing employees of their rights in the workplace can result in lawsuits and fines.

Sexual Harassment Pamphlet
Must distribute to all new hires (recommended for all employees annually and independent contractors)

At the time of hire, all employees must receive a written information sheet on their right to a harassment-free workplace—including the definition of harassment and an employee's right to complain about sexual harassment without fear of retaliation. Distributing these sexual harassment pamphlets could protect you from a devastating lawsuit.

Workers' Compensation Rights & Benefits Pamphlet
Must distribute to all new hires

Employers are required to give a Workers' Compensation pamphlet to all new employees at the time of hire and no later than the first pay period. It informs your employees of their rights and obligations regarding workers' compensation. This pamphlet's content changes frequently, but includes the types of benefits available; how to predesignate a physician who will provide treatment for work-related injuries; what to do if there's a dispute; penalties for making fraudulent claims; and what to do if an employee gets injured at work The pamphlet also includes the Personal Chiropractor or Acupuncturist Designation and Personal Physician Designation forms; and it must be provided in Spanish to employees whose primary language is Spanish.

State Disability Insurance Pamphlet
Must distribute to all new hires and again to any employee taking a leave of absence for a covered reason

The State Disability Insurance (SDI) pamphlet notifies employees of their right to disability insurance benefits should they sustain a non-work-related injury. Including these disability insurance pamphlets in your orientation kits and making sure one is available to every employee taking a leave for a covered reason fulfill an important legal obligation.

Paid Family Leave Pamphlet
Must distribute to all new hires and again to any employee taking a leave of absence for a reason that may entitle them to benefits

Information in the Paid Family Leave (PFL) pamphlet is required by state law and must be provided to all new employees AND employees taking a leave of absence for a reason that may entitle them to PFL wage replacement benefits, such as caring for a seriously ill family member or to bond with a new child. This pamphlet describes the PFL Benefits Program, outlines what makes employees eligible or ineligible for PFL benefits, and explains how to apply for the benefits.

Unemployment Insurance Pamphlet
Must distribute to any employee who is terminated, laid off or takes a leave of absence, or when an employee resigns

The Unemployment Insurance (UI) pamphlet notifies employees of their right to unemployment insurance benefits when they are terminated, laid off, granted a leave of absence, or when an employee resigns. You are required to provide this unemployment information to any employee in any of these instances.

Survivors of Violence and Family Members of Victims Right to Leave and Accommodations Pamphlet
Must distribute to all new employees at the time of hire and to any current employee who requests it

The Survivors of Violence and Family Members of Victims Right to Leave and Accommodations pamphlet describes protections for employees who are victims of domestic violence, sexual assault and stalking to take time off for legal proceedings; the right of victims to take time off to get medical attention or services if your company has 25 or more workers; the right of victims to request reasonable accommodation to make sure they are safe at work; and protections against discrimination and retaliation.
